General Business Terms and Conditions

Online-Reisevermittler Buchungsservice Fuchs serves as an intermediary in cooperation with (agency name and address) and different tourist service providers, which offer various accommodation, hotel, insurance, travel and other services. In order to mediate the services offered by others (from now on referred to as “service providers”), a representation agreement is made between a customer and Online-Reisevermittler Buchungsservice Fuchs. Under the agreement, Online-Reisevermittler Buchungsservice Fuchs is obliged to properly and carefully conduct the preferred mediation. A contract for services is made only with the tourist service provider chosen by the customer along with the preferred services.

1. Conclusion of contract
Online-Reisevermittler Buchungsservice Fuchs forwards the customer’s wishes to those service providers chosen by the customer. A contract for services is realised when tourist services providers confirm them. The contract for services is strictly based on the service provider’s terms and conditions and his service descriptions. Special wishes are optional. According to most of the general travel terms and conditions of the service provider, the agreements which go beyond the limits of the described services specifically require a written confirmation of the acceptance of agreement in order to confirm the travel arrangements. All other verbal agreements are not valid. The accommodation and other described services can be found on the Online-Reisevermittler Buchungsservice Fuchs web pages. When Online-Reisevermittler Buchungsservice Fuchs receives an order for service mediation from a customer, it is primarily a query regarding a binding service, i.e. services. The customer will receive a confirmation about booking possibilities within 2 days. Service providers are bound to that offer for at least 24 hours. The offer expires unless a booking is made by writing, phone or e-mail within that time.

2. Description of services
The offered accommodation facilities are described according to the official classification of tourist facilities which is used when services are published on the internet. The standards of accommodation, food, services, etc. in certain places and regions differ and cannot be compared.

3. Service payment
By order of the service provider, Online-Reisevermittler Buchungsservice Fuchs issues booking confirmations/bills and payment confirmations/vouchers. After receiving the booking confirmation and making out a bill, a deposit is paid into Online-Reisevermittler Buchungsservice Fuchs commission account. Depending on the service provider, the deposit is 10% or 20% of the travel price. The balance is paid to the service provider upon arrival. A contract is fulfilled after Online-Reisevermittler Buchungsservice Fuchs receives the deposit payment. The customer will receive from Online-Reisevermittler Buchungsservice Fuchs a payment confirmation/voucher of the booked service which he will show to the service provider.

4. Travel service price
The travel service prices are listed in Euros. The travel price includes the basic services, which can be found in the description of the booked accommodation. Special services are not included in the travel price. The passenger has to pay for them separately (they are indicated with „by arrangement“ and similar phrases). These services can be defined at the time of booking or at the destination. They are charged in addition to the agreed travel price. Online-Reisevermittler Buchungsservice Fuchs reserves the right to change the listed prices (in case the service provider changes the accommodation fees or the exchange rate changes). In case the deposit has already been paid for a certain booking, Online-Reisevermittler Buchungsservice Fuchs guarantees the accommodation fee. In case prices change before the deposit is paid, Online-Reisevermittler Buchungsservice Fuchs is obliged to inform the customer about the price change.

5. Sojourn tax
In accordance with legal regulations, the sojourn tax is paid at the same time when the booking confirmation/voucher is issued, and is separately listed in the statement of accounts. The price of the sojourn tax depends on the tourist place and the date of travel. It is more closely defined in special conditions which apply to the accommodation facility in question.

6. Cancellation of the booked trip
In case a passenger wishes to cancel his or her booking, he must do so in writing (by letter, fax or e-mail). The changes which do not cause additional costs will be carried out without charge; otherwise, the customer has to pay only for the actual costs. The basis for the statement of accounts in case of trip cancellation is the date of cancellation. The following scale is applied:
- In case of cancellation 30 days before the trip, Online-Reisevermittler Buchungsservice Fuchs keeps the paid deposit.
- In case of cancellation 30 to 15 days before the trip, the customer pays 50% of the travel price.
- In case of cancellation 15 to 2 days before the trip, the customer pays 80% of the travel price.
- In case of cancellation 1 day before the trip or if the passenger does not show up at the booked accommodation facility/destination, he or she pays the full travel price. If the actual costs are higher than those mentioned above, Buchungsservice Fuchs reserves the right to charge them.
The above mentioned cancellation costs also refer to the change of the arranged date of arrival to the accommodation facility as well as all other significant changes. In case the customer transfers his booking to another person, only additional costs caused by that change will be charged (minimum €50). In case of booking cancellation owing to circumstances beyond our control, the passenger pays for only the actual cancellation costs, a maximum of 25% of the total accommodation price.

7. The service provider's right to cancellation and changes
The service provider holds the right to change the booking in case of exceptional, unforeseen or unavoidable circumstances (e.g. war, riots, terrorist actions, strikes, natural disasters, interventions of state authorities, etc.). With the customer’s consent, the booked accommodation may be changed for another one, but only if it belongs to the same or higher category. The accommodation fee remains the same as the one confirmed by the customer upon booking. If the change of booking is not possible, the service provider holds the right to cancel the booking. The passenger will be notified about it at least 5 days before the scheduled date of arrival and will receive the whole amount of money which he already paid.

8. Different service providers' services
A contract for services is not made when Online-Reisevermittler Buchungsservice Fuchs receives an order from the customer to put a query for different service providers about different services and to serve as an intermediary. Due to administrative-technical reasons, Online-Reisevermittler Buchungsservice Fuchs makes out a joint account by order of certain service providers for particular services. In terms of all the individual services, Buchungsservice Fuchs acts only as an intermediary.

9. Travel insurances
We strongly recommend that you take out travel insurance, especially travel cancellation insurance. The customer can arrange his or her own insurance, but is in that case responsible for resolving issues related to insurance.

10. Warranty and complaints
Online-Reisevermittler Buchungsservice Fuchs guarantees only the validity of information, advising and booking procedure within the representation agreement. Online-Reisevermittler Buchungsservice Fuchs does not guarantee the services performed by the service provider. The customer should contact only the corresponding service provider. We would like to draw your attention to the fact that the service provider should be immediately notified about possible problems. In addition, complaints should be filed in written form to the service provider no later than one month after the scheduled end of the trip. The customer should state all the problems that have occurred and provide the evidence of complaint. The warranty provided by Online-Reisevermittler Buchungsservice Fuchs within the representation agreement is limited to the amount of the paid deposit, except in the case of negligence or bad intention.

11. Online-Reisevermittler Buchungsservice Fuchs intermediary obligations
Online-Reisevermittler Buchungsservice Fuchs is obliged to take care of the realisation of the arranged service. Online-Reisevermittler Buchungsservice Fuchs will thoroughly meet all the obligations as it is arranged, except in the case of exceptional circumstances (see section 7).

12. The customer's obligations
The customer is obliged to:
- have valid travel documents - comply with the customs and currency regulations of the Republic of Croatia
- comply with the valid house rules at the booked accommodation facilities and fully cooperate with the service providers
- upon arrival to the accommodation, show the service provider the documents of the executed deposit payment (the original reservation confirmation/bill, payment confirmation/voucher) In case the customer does not comply with these obligations, he must compensate for the costs to the service provider and, if necessary, Buchungsservice Fuchs , the intermediary.

13. Luggage
Online-Reisevermittler Buchungsservice Fuchs does not cover the costs of damaged, destroyed or lost luggage. The same applies to the theft of luggage or valuable items from the accommodation facility (if possible, we strongly recommend that you get a safe-deposit box). The loss or theft of luggage must be reported to the service provider and local police station.

14. Privacy policy
Since we respect your privacy, the following principles are applied: We explicitly say when we need your personal data. We forward your personal data only to that third-party which is important for the booking process. We use your personal data only to process your requests on the internet. Please check your personal data and immediately report any changes or errors so that we can ensure a smooth exchange of information about our services.

15. Changes of business terms
Buchungsservice Fuchs reserves the right to change the terms of use of these pages and other business terms. The changes do not affect the already made and paid bookings.

16. The terms of use of these pages
Online-Reisevermittler Buchungsservice Fuchs website serves only to inform the customers about the service providers’ offers based on descriptions and photos, to check the available dates for booked accommodations and to make bookings. We would like to draw your attention to the fact that the transactions via our web pages can be made only by adults. Taking this into consideration, you are taking full financial responsibility for your transactions or transactions made by minors in your household. Also, you are responsible for the minors who are using your personal data as well as the authenticity and accuracy of your personal data, which you gave us for the purposes of bookings and financial transactions. In case you misuse these web pages (false reservations, etc.), your access will be denied.

17. Note
By paying the deposit for the booking of accommodation, the customer fully accepts these General Business Terms and Conditions. Online-Reisevermittler Buchungsservice Fuchs holds all the rights, including the right to errors and misprints.

18. Court competence
The passenger can sue the travel agency only at its headquarters.
